Fee Schedule
It is our objective to provide mediated dispute resolution services at a reasonable cost to the parties involved in, or about to become involved in litigation.
The scheduled mediation fee covers the cost of one mediation session, as well as scheduling and administration of the mediation, usually a working lunch at noon, for full day sessions, and limited telephone conferences with the attorneys before and, if necessary, after the mediation session.
The parties have the option of a half day or full day mediation session. A half day mediation session which consists of four (4) hours, has a flat rate fee of $700.00 per party. A full day session consists of eight (8) hours, and has a flat rate fee of $1,200.00 per party. Payment is due and earned upon commencement of the initial mediation session.
All parties represented by the same lawyer or law firm are considered a single party for purposes of calculating the mediation fee. Each party agrees to pay his pre-determined share of costs prior to commencement of the initial mediation session.
A typical full mediation day shall consist of eight (8) hours, beginning at 9:00 a.m. with a working lunch at noon and continuing through 5:00 p.m. Any overtime required beyond the four (4) hours for half day, or eight (8) hours for full day, shall be charged at $300.00 per hour split between the parties. Any additional fees are due the day of the mediation. We prefer full payment on the day of the mediation, however, if you are unable to make payment on the mediation date, we will provide for payment of the fees in your mediated settlement agreement.
Subsequent sessions are usually not necessary, but, if required, they are typically scheduled by mutual consent at the conclusion of the mediation session. The fee arrangements for subsequent sessions are the same as for the initial session unless other arrangements are mutually agreed upon in advance.
Cancellation of a scheduled mediation session should be accomplished in a timely manner, well in advance of the mediation session, as to prevent scheduling issues and any other problems that may arise for all involved. To avoid such problems, a cancellation fee of $600.00 ($350.00 for half day sessions) is due and payable upon cancellation by any party who cancels a mediation session less than six (6) days in advance of the scheduled mediation session.
Prior to the mediation session, the parties may submit any materials they wish the Mediator to review, including a position statement for the Mediator’s confidential use. This will enable the Mediator to become familiar with all relevant issues involved in the case.
Good faith and authority to resolve the matters in dispute are essential to the mediation process. Participants should come with full authority to settle and sincere intentions to work for the resolution of all the matters required for successful settlement.
Locations and facilities for mediation are mutually agreed upon inadvance through consultation with the parties or their representatives. We are available for travel to virtually any location both mutually agreeable and convenient to the parties and counsel.
