MEDIATION SERVICES

(FULL AND HALF DAY)

Fees are due and earned upon commencement of the mediation session at a rate of $2,800 ($350/hr) per full day for a two-party mediation and an additional $900 per day for each additional party, with the entire cost divided equally among all parties unless other arrangements are agreed upon in advance. Parties represented by the same attorney or law firm ordinarily are considered a single party in calculating the mediation fee. Mediation scheduled for a full day require a minimum of $2800. Hourly rates are available at $175.00-per-party for a minimum half-day session of four hours.

Scheduling is flexible, but a typical full-day mediation session begins at 9:00 a.m. and continues through a working lunch until 5:00 p.m. The hourly rate applies for each hour a mediation extends beyond eight hours. The quoted fees include all mediator preparation and incidental expenses to the mediation other than transportation and lodging expenses required for travel. Such travel expenses are limited to those which are reasonable and necessary and their cost will be divided equally among the parties unless otherwise agreed upon in advance.

Good faith and authority of participants to resolve the matters in dispute are essential to the mediation process. Participants should come with full authority to settle and sincere intentions to work for the resolution of all issues and matters required for successful settlement.

Subsequent sessions are usually not necessary, but, if required, they are typically scheduled by mutual consent at the conclusion of the mediation day. The fee arrangements for subsequent sessions are the same as for the initial session unless other arrangements are mutually agreed upon in advance.

Cancellation of a mediation session should be accomplished sufficiently in advance to avoid causing scheduling and other problems for all others involved. To avoid such problems, a late cancellation fee of $750 ($375 for half-day mediation) is payable upon cancellation by any party who cancels a mediation less than six days before the mediation is scheduled to begin.

Locations and facilities for mediation are mutually agreed upon in advance through consultation with the parties or their representatives. We are available for travel to virtually any location mutually agreeable and convenient to the parties and counsel.

Advance information which should be forwarded to us before the mediation includes Attorney Information Sheet and request for mediation and/or:

  • A list of parties and their representatives;
  • A Mediation Statement, a brief narrative summary by each party of their perspective of the controversy, including copies of relevant legal authorities;
  • Copies of live pleadings if a lawsuit has been filed;
  • The terms of any previous settlement proposals.
